These Website Terms of Use ("Terms") govern your use of garbys.org, operated by Garby's LLC ("Garby's," "we," "us," or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

Website Information Only

The website provides general information about Garby's, including menu items, prices, availability, locations, schedules, catering, and contact information. We try to keep this information accurate, but food-truck operations can change. Menu items, ingredients, portion sizes, prices, service areas, hours, locations, and availability may change at any time without notice. Website information is not a guaranteed offer and may differ from information available at the truck or in a written catering proposal.

Catering Requests and Bookings

Submitting a catering form is an inquiry only. It does not reserve a date, guarantee availability, establish a price, or create a contract. A catering booking becomes binding only when Garby's and the customer complete any required written agreement, the customer accepts the final menu and price, and Garby's receives any required deposit or other confirmation stated in that agreement.

Any estimate or proposal may be subject to an expiration date, minimum order, service fee, travel fee, staffing fee, tax, gratuity, venue requirements, or other terms stated in the proposal or catering agreement. If these Terms conflict with a signed catering agreement, the signed catering agreement controls for that event.

Menu, Pricing, and Availability

Prices shown on the website are current only as of the time posted and may change. Taxes, delivery, travel, staffing, service charges, gratuities, event-specific costs, and custom requests may not be included unless expressly stated. Photographs are illustrative. Actual appearance, ingredients, presentation, and portions may vary.

Allergies and Dietary Requests

Food may be prepared in areas or with equipment that also handles common allergens, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame. Cross-contact may occur. Website descriptions and staff statements are not a guarantee that an item is allergen-free. Customers with a food allergy, intolerance, or dietary restriction should contact Garby's before ordering or finalizing a catering menu. Garby's will discuss reasonable requests, but may not be able to accommodate every restriction.

Acceptable Use

You may use the website only for lawful, personal, and legitimate business-inquiry purposes. You may not:

  • interfere with the website's operation or security;

  • attempt unauthorized access to the website, accounts, systems, or data;

  • submit false, misleading, fraudulent, unlawful, or harmful information;

"Garby's" and related branding may not be used in a manner that suggests sponsorship, affiliation, or endorsement without prior written permission.

The website may link to social media platforms, maps, or other third-party services. We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices. Accessing a third-party service is at your own discretion and subject to that provider's terms.

Disclaimer of Warranties

To the fullest extent permitted by law, the website is provided "as is" and "as available." Garby's disclaims warranties regarding the website's uninterrupted availability, security, accuracy, completeness, or fitness for a particular purpose. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Garby's and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the website. This limitation does not apply where liability cannot legally be limited or excluded.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Garby's and its owners, employees, and contractors from third-party claims, damages, or expenses arising from your unlawful use of the website, your violation of these Terms, or information you submit through the website.

Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any action arising from these Terms or the website must be brought in a court of competent jurisdiction located in Clark County, Nevada, unless applicable law requires otherwise.

Changes and Severability

We may revise these Terms by posting an updated version and changing the effective date. If any provision is found unenforceable, the remaining provisions will continue in effect.
